Terms of Service

Stay informed as you stay connected. Review the terms that guide your use of the Decatur Shelby County YMCA's website and online services, including what you can expect of us and your responsibility as a user.

EFFECTIVE: 10/15/2026

LAST UPDATED: 10/15/2026

ACCEPTANCE AND SCOPE OF THESE TERMS

These Website Terms of Use (“Terms”) govern your access to and use of dscymca.org (the “Site”), which is operated by the Decatur Shelby County YMCA (“YMCA,” “we,” “our,” or “us”).

Please read these Terms carefully before using the Site. By accessing or using the Site, you accept and agree to these Terms. If you do not agree to these Terms, please do not use the Site.

These Terms govern only access to and use of the Site. YMCA memberships, programs, childcare services, facility rentals, registrations, payments, donations, employment opportunities, and other services or transactions may be governed by separate agreements, waivers, policies, payment authorizations, eligibility requirements, refund policies, codes of conduct, and registration terms. If these Terms conflict with a more specific agreement governing a YMCA service or transaction, the more specific agreement will control.

Use of the Site is also subject to the YMCA’s Privacy Policy, which describes how the YMCA collects, uses, and discloses personal information.

ACCESS TO THE SITE

We may update, suspend, restrict, withdraw, or discontinue all or any portion of the Site at any time. We do not guarantee that the Site or any content will always be available.

We may restrict or terminate a user’s access to the Site if we reasonably believe the user has violated these Terms, misused the Site, or engaged in unlawful or harmful activity.

PERMITTED AND PROHIBITED USES

You may use the Site only for lawful, personal, and noncommercial purposes. You agree not to:

· Use the Site in violation of applicable law;

· Interfere with the operation, availability, or security of the Site;

· Attempt to gain unauthorized access to the Site or any related system, account, server, computer, or database;

· Introduce viruses, malicious code, or other harmful technology;

· Impersonate another person or misrepresent your identity or affiliation;

· Use the Site to infringe or violate another person’s intellectual-property, privacy, or other legal rights; or

· Use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with another person’s use of it.

INTELLECTUAL PROPERTY

The Site and its content, including text, images, illustrations, photographs, graphics, documents, audio and video content, logos, names, designs, and other materials, are protected by copyright, trademark, and other intellectual-property laws. These materials are owned by the YMCA, licensed to the YMCA, or used with permission from the applicable rights holder.

YMCA names, logos, trademarks, and brand elements may be owned by or licensed through YMCA of the USA.

You may view, download, or print a reasonable number of Site pages or materials for your personal, noncommercial use. You may also share links to publicly available Site content, provided you do not suggest an association with, approval by, or endorsement from the YMCA that does not exist.

Except as permitted above or by applicable law, you may not copy, reproduce, republish, distribute, modify, publicly display, publicly perform, create derivative works from, or use Site materials for commercial purposes without prior written permission from the applicable rights holder. You may not remove or alter copyright, trademark, or other proprietary notices from Site materials.

No right, title, or interest in the Site or its content is transferred to you. All rights not expressly granted are reserved.

THIRD-PARTY WEBSITES AND PLATFORMS

The Site may contain links to third-party websites and platforms used for memberships, program registrations, payments, donations, event tickets, applications, schedules, employment opportunities, social media, maps, videos, and other resources.

Some third-party platforms provide services in support of YMCA activities, while others operate independently. Access to and use of a third-party website or platform may be subject to that provider’s own terms, privacy policy, and practices.

The YMCA does not control the content, availability, security, or independent practices of third-party websites and services. A link does not necessarily indicate that the YMCA endorses all content, products, services, or practices of the linked site.

ACCURACY AND AVAILABILITY OF INFORMATION

The YMCA makes reasonable efforts to keep information on the Site accurate and current. However, we do not guarantee that Site content is complete, accurate, reliable, current, or continuously available.

Membership rates, program fees, schedules, facility hours, program availability, descriptions, eligibility requirements, and other information may change. We may correct errors and update or remove Site content at any time.

Submitting an application, inquiry, registration, payment, or donation through the Site or a linked platform does not guarantee:

· Membership or program participation;

· Financial assistance or a scholarship;

· Volunteer placement;

· Facility or rental availability;

· Employment; or

· Any other requested result.

The Site and its content are provided for general informational purposes. Site content does not amend or replace any applicable membership agreement, program registration, waiver, childcare agreement, rental agreement, payment authorization, employment document, YMCA policy, or other service-specific document.

DISCLAIMER OF WARRANTIES

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the YMCA makes no express or implied warranties regarding the Site or its content, including warranties concerning accuracy, completeness, availability, reliability, security, or freedom from errors or harmful code.

The YMCA does not warrant that the Site will always be available, uninterrupted, secure, or free from viruses or other harmful materials.

Nothing in these Terms excludes a warranty or other right that cannot legally be excluded.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, the YMCA will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:

· Access to, use of, or inability to use the Site;

· Reliance on Site content;

· Errors or omissions in Site content;

· Interruptions or delays in Site availability;

· Unauthorized access resulting from circumstances beyond the YMCA’s reasonable control;

· Viruses, malicious code, or other harmful technology; or

· Access to or use of a linked third-party website or platform.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.

These limitations relate only to the Site and its content. They do not replace or modify the terms, waivers, limitations, or other provisions contained in an agreement governing a YMCA membership, program, childcare service, facility rental, registration, payment, or other service.

INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless the YMCA and its officers, directors, employees, volunteers, and agents from third-party claims, liabilities, damages, losses, costs, and reasonable attorneys’ fees arising from your unlawful misuse of the Site, material violation of these Terms, or infringement of another person’s rights.

GOVERNING LAW AND VENUE

These Terms and matters relating to the Site are governed by the laws of the State of Indiana, without regard to its conflict-of-law principles.

Any legal action arising from or relating to these Terms or the Site must be brought in a state or federal court having jurisdiction in Indiana, subject to any rights or remedies that cannot lawfully be limited by these Terms.

WAIVER AND SEVERABILITY

The YMCA’s failure to enforce a provision of these Terms does not waive its right to enforce that provision or any other provision.

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in effect.

CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to the Site, our practices, or applicable requirements.

When changes are made, we will post the revised Terms on the Site and update the Effective Date or Last Updated date shown above. Changes apply prospectively from the date they are posted.

Your continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms.
